Top Legislator on Enforcing Criminal Procedure Law

Chinese top legislator Li Peng said Monday that public security and judicial departments should take effective measures to solve various problems arising from the implementation of the Criminal Procedure Law to ensure justice.

Li Peng, chairman of the Standing Committee of National People's Congress (NPC), made the remark at a conference on the inspection of the implementation of the Criminal Procedure Law by the NPC Standing Committee.

While discussing some typical cases and problems with the participants, Li hailed the important role the Criminal Procedure Law plays in fighting crime, safeguarding the citizens' legitimate rights and maintaining social stability.

Li stressed that in order to root out malpractice that is against the Law, such as detaining of suspects for excessive periods of time and inquisition by torture, the following should be given adequate attention.

-- Police and judicial personnel should enhance their legal awareness and give adequate attention to legal procedures.

-- Some specific and workable regulations should be made to clearly define the duties of the public security department, court and procuratorate.

-- The current criminal procedure system should be improved to deal with the existing problems.

-- The political and professional quality of police and judicial personnel should be improved to correctly use legal procedures to fight crime and protect the legitimate rights of the general public.

In September of this year, the NPC Standing Committee sent inspection groups to supervise how the Criminal Procedure Law was carried out in Tianjin, Inner Mongolia Autonomous Region, Helongjiang, Zhejiang, Hubei and Shaanxi provinces.
