A Beverly Hills judge ruled Tuesday that actress Lindsay Lohan violated the terms of her probation in a pair of drunk driving cases by missing multiple classes at a court-ordered alcohol-education program and sentenced her to 90 days in jail.
The 24-year-old former Disney star broke down sobbing when Beverly Hills Superior Court Judge Marsha Revel pronounced the sentence. She was ordered to surrender in Revel's courtroom on July 20 to begin serving her jail term in Los Angeles County Jail.
"She knew [the prosecutor] would be asking for jail time and yet still after all that, she didn't comply with the court order and the court does find her in violation of her probation," Revel said at Tuesday's probation-violating hearing.
She noted that Lindsay's had a history of noncompliance and " ongoing excuses."
"She had to go once a week," the judge said. "I ordered her to do it and I couldn't be more clear and it wasn't done."
The 90 days stems from the 30 days possible for each of Lohan's original infractions: her two Driving Under the Influence (DUI)s and a count of reckless driving.
The judge also ordered Lohan to take part in a 90-day inpatient substance-abuse program after she is released from jail.
On May 26, 2007, the actress was in a Mercedes-Benz that crashed into a hedge along Sunset Boulevard near the Beverly Hills Hotel, and two months later she was arrested in Santa Monica on suspicion of DUI.
That August, she pleaded no contest to two counts each of drunken driving and being under the influence of cocaine, and one count of reckless driving. She spent 84 minutes in jail later that year in connection with her plea and placed on three years probation.
Her probation was extended for a year in October after she missed some alcohol-education classes while making a movie in Texas.
On May 20, Lohan failed to show up for a court hearing because she was at the Cannes Film Festival. She showed up four days later, when she was ordered to wear a SCRAM alcohol-monitoring ankle bracelet as a condition of her release on bail pending Tuesday's probation hearing.
On June 6, however, the SCRAM bracelet indicated that the actress may have consumed alcohol, in violation of her bail, after she attended the MTV Movie Awards. Revel doubled Lohan's bail, and the actress posted a bond with the court, allowing her to remain out of custody.
Although conceding that Lohan was ordered to wear a SCRAM alcohol-monitoring ankle bracelet as a condition of her bail when she appeared in court in May, Revel did not consider the SCRAM anklet as part of her determination of whether Lohan violated probation.
Revel ordered that Lohan continue wearing the SCRAM device until she reports to jail, and ordered her not to drink any alcohol as a condition of her continuing probation.
The former Disney darling rose to fame between 2003 and 2005 when she appeared in title roles in the films of "Freaky Friday," "Mean Girls" and "Herbie: Fully Loaded." Her career was interrupted in 2007 when she was involved in two drunk driving incidents and three visits to rehabilitation facilities. She guest starred in the TV series "Ugly Betty" and other productions.
