SIPO: Formulation And Implementation of State IP Strategy

"In his government work report delivered on March 5 Premier Wen Jiabao pointed out, we must work harder to formulate and implement a state intellectual property strategy and strengthen intellectual property protection in earnest.

This is the first time in the premier's government work reports to put forward a state intellectual property strategy. By two simple sentences the issue of intellectual property is raised to the level of state strategy, which will have significant influence on the development of China's society and economy."

This is what was expressed at a group discussion on March 6 by Li Yuguang, member of the CPPCC and deputy director of the SIPO. He rendered four suggestions on China's implementation of the state IP strategy.  

Having given an overall introduction of IP development at home and abroad, he pointed out, China's IP activity at the present stage is seen generally with something not in line with the development requirement of state economy, science and technology and society, and something not in compatibility with the international situation. It is mainly reflected in that governments at all levels need to further better their understanding of the importance of IP work, the broad masses need to enhance their legal concept of IP, the IP work policy is not adequately in place and the IP departments need to improve their management and efficiency, etc.

"With a view to speed up the healthy development of China's IP activity and enable China to hold a positive position in the process of participating economic globalization, we need to implement comprehensively the requirements and targets raised for IP strategy by Premier Wen Jiabao in his government work report." so expressed Li Yuguang.

He suggested at three points: first, greater efforts should be made on the IP publicity, education and generalization so as to make the whole society fully understand the creation, management, use and protection of IP rights; second, due encouragement should be given to the creation, management, use and protection of IP rights, especially in the historical process of building China into a self-innovation-oriented country and fulfilling the state medium and long-term plan for the development of science and technology, more support and help are necessary; third, it is hoped that the government will streamline the IP management system. At present, IP management is conducted at high cost in a scattered way without effective mechanism of communication and coordination, therefore, it is difficult to build up the state power of IP protection.

Li Yuguang further proposed that the government give an overall consideration to the integration of China's existing IP management resources which can be conducted by the government of next session in its operation.

Besides, he hoped that formulation of the IP strategy will be completed as early as possible in order that it can be launched throughout the country. In the course of implementation, the short, medium and long-term goals should be set up and they can be accomplished in an organized and gradual manner.
